Terms & Conditions
This agreement is between Emily Hankins Cakes as supplier and you, the customer.
Placing an order
When you place an order, Emily Hankins will confirm in writing:
· A list of items to be supplied;
· The price of each item and the total price of the goods;
· The cost of delivery, if applicable;
· Whether the items are to be delivered or collected by you from Emily Hankins’ premises;
· The date and time of delivery or collection.
· The full address, including postcode, to which goods are to be delivered.
Price and payment
Emily Hankins’ cakes and favours are individually hand-made for your special occasion.
A deposit of 35% of the total price of the goods is payable when your design had been confirmed and you place your order.
The booking is not a confirmed order until the deposit has been paid and no work will be undertaken until the deposit has been received.
The balance of the price of the goods is payable within 14 days of the delivery/collection date specified in the order confirmation. (28 days for tea cups and saucers.) Balance payments can be made in advance of this timeframe if you wish.
Orders placed less than 6 weeks prior to the delivery date must be paid in full on booking.
IF FULL PAYMENT HAS NOT BEEN RECEIVED BY THE DELIVERY DATE, THE CAKE WILL NOT BE DELIVERED.
The cost of delivery (if applicable) is also payable when the goods are delivered to the address specified in the order confirmation.
Payment can be made via:
· Direct Bank/Building Society Transfer
· Cash
· Cheque
Changes and cancellation
Any changes to your order or to the date and time of collection or delivery must be agreed with Emily Hankins, who will confirm them in writing to you. Emily Hankins reserves the right to increase a quoted fee in the event that the customer requests a significant variation to the work agreed.
If you cancel your order more than 90 days in advance of the date of collection or delivery, Emily Hankins will refund your deposit in full.
Deposits are not refundable for cancellations made after 90 days of the date of collection or delivery.
Full payments made less than 14 days in advance of the delivery date are non-refundable.
Full payments made more than 14 days in advance of the delivery date are subject to a cancellation fee if cancelled more than 14 days in advance of the delivery date. Emily Hankins cannot refund the cost of any orders cancelled with less than 14 days notice.
Orders paid in full and cancelled with more than 14 days notice will receive a partial refund of 50% of the total amount paid.
In the very unlikely event that Emily Hankins has to cancel your order for any reason, then as much notice as possible will be given. Emily Hankins will discuss the matter with you and try to agree a suitable alternative. If you do not wish to accept the suggested alternative, then Emily Hankins will refund the full price to you.
Delivery and acceptance
Emily Hankins takes pride in delivering her cakes and favors on time and in perfect condition.
It is the customer’s responsibility to ensure you have supplied the correct delivery information and that someone is available to receive your cake. A signature will be required for the receipt of your order upon delivery.
In the unlikely event that Emily Hankins fails to provide the items specified in the order or items are significantly damaged prior to collection or delivery, you can either:
a) accept and pay for the delayed or damaged items.
or
b) reject the delayed or damaged items in which case Emily Hankins will refund the balance paid.
Once the cake has been collected or signed for on delivery, Emily Hankins cannot be held responsible for any damages thereafter.
Emily Hankins shall not be liable for any consequential losses, damages or other costs arising from a failure to fulfil the contract.
Allergies
Please be aware that whilst your chosen cake may not be made with nuts or a nut product, it will be prepared in a kitchen where nut products may be used in other cakes and fillings. Information concerning dairy, wheat or gluten allergies can be provided on request.
Fresh flowers and non edible items
If you choose to have fresh flowers on your cake please be aware that not all flowers and foliage are safe to be in contact with food. It is your responsibility to check with your florist that any flowers supplied are suitable for this specific use. If you or your florist have concerns around this Emily Hankins is happy to discuss this with you.
Emily Hankins has the right to refuse to apply flowers to the cake if she feels they are not food safe.
Cake flowers supplied by a florist need to be available at the venue before the agreed cake delivery time to ensure there is enough time to apply them to the cake correctly.
Your cake will have central dowels to keep the structure secure. Please ensure these are removed before the cake is served.
If there are any other non edible items used in your cake design, such as flower wires or ribbon these will be noted on your customer order form.
photographs
Emily Hankins always takes photographs of her cakes once they are set up at the venue as proof of safe delivery. Emily reserves the right to use these photographs on her website/social media unless previously requested otherwise.
By choosing to share any professional photographs with Emily Hankins after your wedding date you are giving permission for these to be used for promotional purposes unless requested otherwise.
